Report: Ex-PSU president OK'd not reporting abuse

STATE COLLEGE, Pa. (AP) ? A news organization says it has seen emails showing Penn State's former president Graham Spanier agreed not to take allegations of sex abuse against ex-assistant football coach Jerry Sandusky to authorities but worried university officials would be "vulnerable" for failing to report it.

CNN says the emails, first reported by NBC, followed a graduate assistant's 2001 report of seeing Sandusky sexually assaulting a boy in a team locker room shower.

The emails show athletic director Tim Curley and retired vice president Gary Schultz intended to report the allegation, then reconsidered. Spanier responded that he was "supportive" of their plan, but he worried they might "become vulnerable for not having reported it."

Sandusky was convicted this month of 45 counts of sexually abusing 10 boys. The scandal led to the ouster of Spanier and revered coach Joe Paterno and charges against Curley and Schultz, who are accused of perjury for their grand jury testimony and failing to properly report suspected child abuse. Spanier hasn't been charged.

The CNN report cites an email from Schultz to Curley on Feb. 26, 2001, 16 days after graduate assistant Mike McQueary told veteran coach Joe Paterno about the shower assault. Schultz suggests bringing the allegation to the attention of Sandusky, Sandusky's charity and the Department of Welfare, which investigates suspected child abuse, according to the report.

But the next night, Curley sent an email to Spanier, saying that after thinking about it more and talking to Paterno, he was "uncomfortable" with that plan and wanted to work with Sandusky before contacting authorities, the report said.

If Sandusky is cooperative, Curley's email said, "we would work with him. .... If not, we do not have a choice and will inform the two groups," according to the report.

Spanier wrote back and agreed with that approach, calling it "humane and a reasonable way to proceed," according to the report. But he also worried about the consequences.

"The only downside for us is if message isn't 'heard' and acted upon and we then become vulnerable for not having reported it, but that can be assessed down the road," the email said, according to CNN.

Spanier's attorney didn't immediately return a call from The Associated Press seeking comment Saturday.

Schultz and Curley's lawyers on Saturday echoed recent comments by Gov. Tom Corbett about the need for a solid case before charging Sandusky. Corbett began the investigation in 2009 when he was attorney general.

"For Curley, Schultz, Spanier and Paterno, the responsible and 'humane' thing to do was, like Governor Corbett, to carefully and responsibly assess the best way to handle vague, but troubling allegations," the lawyers said. "Faced with tough situations, good people try to do their best to make the right decisions."

Paterno, ousted by the school's board of trustees for what was called his "failure of leadership" surrounding allegations against Sandusky, died of lung cancer in January. After Sandusky's arrest, Paterno said through a spokesman that he reported the allegation to the head of his department and "that was the last time the matter was brought to my attention until this investigation and I assumed that the men I referred it to handled the matter appropriately."

Schultz, 62, and Curley, 58, deny the allegations and have asked a judge to dismiss the charges. A status conference for their case is scheduled for July 11.

Spanier sued Penn State in May to try to get copies of his email traffic from 1998 to 2004, citing the pending investigation being conducted on the university by former FBI director Louis Freeh. Two weeks ago, lawyers for Penn State asked a judge to throw out the lawsuit and said the attorney general's office, which is prosecuting Curley and Schultz, had asked them not to provide Spanier with the emails.

2012 NBA Draft Results: Texas A&M Forward Khris Middleton Selected By Pistons With No. 39 Pick

The Detroit Pistons used their second pick of the draft to take Texas A&M forward Khris Middleton.

The 6-for-8, 216-pound Middleton averaged 13.2 points, 5.0 rebounds and 2.3 assists for the Aggies last season. He still is growing into his body, so the Pistons will have a bit of a project. Middleton has the ability to score inside and outside and had a smooth shot. He's not the best ball-handler, and will need to bulk up a bit. He'll need to catch up physically to match his skills, but does have good upside for Detroit.

Kate the WASP (a.k.a. New York comedian Kate Hendricks) is once again traveling outside her comfort zone. This time, she's checking out the Pride Parade in New York City, a celebration of gay culture and gay rights held every year in Manhattan (among other cities).

As support for gay rights has expanded exponentially lately, Kate felt that it was time to jump on the bandwagon and figure out what's going on with the gays, anyhow. In order to truly understand them, Kate immerses herself into the parade, much like she did in the Puerto Rican Day Parade recently. And it goes just about as well as you'd think.

So did she learn the true meaning of Pride Month? Her heart might be in the right place, but as she puts it, she can't help but embarrass herself. Or as she puts it, "Birkinstock-in-mouth" all day.

Egypt's new president to take oath before court

CAIRO (Reuters) - Egypt's Islamist President-elect Mohamed Mursi will give a speech to crowds in Tahrir Square on Friday but his party appears to have lost in a power struggle with the ruling military council over where he will take his oath of office.

Details about the historic swearing-in ceremony were announced in a late statement from the presidency on Thursday which stated that Mursi will take the oath of office in front of the Supreme Constitutional Court on Saturday at 11 a.m. Cairo time (0900 GMT).

After being sworn-in as the first freely elected civilian president of the biggest Arab state, Mursi will attend a celebration in Cairo University where he will give a speech, according to the presidency statement.

The Muslim Brotherhood had wanted Mursi sworn-in before parliament, in line with past practice, but an army-backed court dissolved the Islamist-dominated lower house earlier this month.

The generals said the same court should hear Mursi take his oath of office.

Mursi held talks about the oath-taking on Thursday with the Muslim Brotherhood's general guide Mohamed Badie and prominent public and legal figures and politicians at the presidential palace.

Following the meetings, a presidential spokesman issued a statement that mentioned only Mursi's plans to address the nation on Friday from Tahrir Square where hundreds of protesters have been camped out for weeks to press the military council to swiftly transfer all powers to civilian rulers.

Later, a senior judge in the Supreme Constitutional Court told the state news agency MENA that Mursi would take the oath in front of a panel of Judges from the Supreme Constitutional Court on Saturday.

The army council that has ruled Egypt since pushing former President Hosni Mubarak aside to calm a popular uprising last year has promised to hand back control by July 1.

Yet the military has demonstrated that it intends to keep its hands firmly on the real levers of power.

Field Marshal Hussein Tantawi, 76, who served as Mubarak's defense minister for two decades, will keep that post in Mursi's future cabinet, an army council member said on Wednesday night.

"The government will have a defense minister who is head of the Supreme Council of the Armed Forces," Major-General Mohamed Assar said on private CBC television.

Asked by the talk show host if this meant Tantawi would keep his defense portfolio, Assar said: "Exactly. What is wrong with that? He is the head of the SCAF, the defense minister and the commander of the armed forces."

The military council led by Tantawi has managed a turbulent and sometimes violent transition period in which Egypt's first free parliamentary and presidential elections have taken place.

Assar's assertion that Tantawi would remain in place even before Mursi has been sworn in on Saturday illustrates the limits the military seeks to set on his presidential authority.

POWER GRAB

In a statement on June 17, the generals cut a swathe through their own previous interim constitutional decree, as well as the Mubarak-era constitution, grabbing more power for themselves.

The republic's past presidents, all drawn from the military, have had the title of supreme commander of the armed forces.

Under the new decree, the SCAF said it was in charge of all military affairs and that its head, not the president, would command the armed forces until a new constitution is written.

After the Supreme Court ordered parliament dissolved on June 14, the SCAF assumed legislative powers, which Assar said it would also exercise until a new assembly is elected.

Among other actions in a package denounced by the Muslim Brotherhood as a military coup before Mursi's election win was confirmed on Sunday, the council also named a National Defense Council to run defense and foreign policies.

Although Mursi and his future prime minister will also serve on the council, they will be outnumbered by the generals in a body whose decisions will be taken by majority vote.

Assar insisted that Mursi, a 60-year-old U.S.-trained engineer, would have full presidential prerogatives, even as he outlined curbs on his right to decide on war or peace.

"The president is the head of state with full powers. The president makes a decision to go to war in consultation with the military rulers," Assar said, adding that this was normal practice in other countries, including the United States.

The United States, determined to preserve Egypt's peace treaty with Israel and U.S. access to the Suez Canal, must now deal with the Muslim Brotherhood, despite its doubts about the Islamist group's intentions, as well as with the military, even though its commitment to democracy seems at best uncertain.

"We're keeping the lines open" to all sides, said one U.S. official who spoke on condition of anonymity.

The deliberate even-handedness was visible on Sunday when U.S. President Barack Obama took the rare step of calling both Mursi and losing presidential candidate Ahmed Shafik, the former air force chief and Mubarak's last prime minister.

U.S. Secretary of State Hillary Clinton, who has delayed plans to visit Egypt for now, this week urged Mursi to include women, Christians and secular liberals in his government.

(AP) ? A massive stage collapse hours before a Radiohead concert was to begin Saturday left one person dead and three others injured, officials said.

Emergency Medical Services deputy commander David Viljakainen said a man who was trapped under the rubble was pronounced dead at the scene. Officials said he was in his mid-30s.

A 45-year-old man was hospitalized with a head injury and two others were treated at the scene for minor injuries at the Downsview Park venue, said Viljakainen.

The venue said on its website that the sold-out concert was canceled.

Fire Services Platoon Chief Tony Bellavance said officials were alerted to a person trapped under the rubble and crews assisted in extracting the victim. "It was a crushing injury that killed the man," he said.

Police spokesman Tony Vella said crew were setting up the stage when it collapsed.

"They were setting up when the top portion collapsed on top of them. Unfortunatly, four people were hurt. The remainder of the people, when they heard the stage coming down, ran from the area," Vella said.

Dusty Lalas, an employee with Toronto Radio Station "The Edge," which was sponsoring the concert, said the structure suddenly caved in.

"There was a loud crash and it sounded like sheet metal and lightning and we just saw the stage collapse," Lalas said.

Radiohead tweeted that "due to unforeseen circumstances tonight's concert at downsview park tonight has been canceled. Fans are advised not to make their way to the venue."

Radiohead's website had listed the concert as being sold out, with 40,000 tickets sold.

Jaime Rivest, 33, said at around 4 p.m. the stage suddenly came down, crumpling and falling onto itself.

"It was like a tornado hit the stage and in just moments the stage came down with metal everywhere," she said.

Rivest said security officials rushed to evacuate the area. She said there was possibly about 1,000 people there hours before Radiohead was to take the stage at 9:30 p.m. The doors for the show opened at 5 p.m. and other acts were scheduled to perform.

Police said the park wasn't full, but there was a considerable crowd of people already waiting for the show amid sunny and clear conditions.

Viljakainen said the Ministry of Labor would investigate to determine the cause of the collapse.

There have been a number of concert stage collapses in recent years.

In Canada, one person died and several people were injured when the stage went down at Bluesfest in Ottawa last July, and one person died and more than a dozen were injured in 2009 when a powerful windstorm caused the main stage to collapse at the Big Valley Jamboree near Camrose

Six people died last August when the stage collapsed at a Sugarland concert in Indianapolis; five died in Belgium when a storm swept in and toppled the stage at the Pukkelpop Festival.

Small business lending down in April. Small business lending is down for the fourth straight month, according to the Thomson Reuters/PayNet Small Business Lending Index. The index measures the volume of US small business lending and showed a drop from 96.0 in March to 94.1 in April, indicating businesses are playing it safe instead of borrowing for future expansion. Small businesses were desperate for enough funding to stay alive back in the early days of the Great Recession, but now they have access to an unprecedented $30 billion in SBA guaranteed loans for buying more equipment and hiring more staff, says SBA Administrator Karen Mills.
